At the Forefront of Landmark Cases
In 2006, in the case of Lewis v. Harris, the New Jersey Supreme Court was called upon to address the issue of same sex marriage in New Jersey. Scott Adam Laterra, Esq. of Laterra & Hodge, LLC was asked by the Family Law Section of the New Jersey State Bar to co-author the amicus curiae brief that was submitted to the high court on behalf the State Bar.
Protecting Your Rights & Best Interests
The result of this landmark decision was the birth of the civil union in New Jersey. As a result of New Jersey Supreme Court’s decision in Lewis v. Harris, same sex partners who enter into civil unions are afforded the same substantive rights at the termination of their civil union that married couples have when going through a divorce.
Just as married couples are entitled to be heard on issues, so are same sex partners at the dissolution of their civil union. These include:
- Child custody
- Parenting time
- Child support
- Alimony
- Equitable distribution
