In New Jersey, family law cases like divorce usually end in one of two ways: a settlement or a trial. Most cases are settled through negotiation. How quickly a settlement is reached can greatly affect both the cost and emotional strain. Starting mediation early can save time and money. For instance, if a divorce goes to court, mandatory economic mediation is one of the final steps, and parties must participate unless they settle beforehand. The court also requires mediation for custody and parenting time. Instead of spending months or even years in court and then being forced into mediation later, couples can start with mediation right away to reach a fair solution. Confidentiality
Mediation is a confidential process. Offers made during mediation stay private and cannot be used in court.
